Terms of Use

1. Eligibility

You must be at least 13 years old to use NiceApp. If the law where you live requires a higher minimum age to consent to online services, you must meet that age or have permission from a parent or legal guardian. You must be legally able to enter into this agreement.

2. Your Account

• Provide accurate registration information and maintain only accounts you are authorized to use.
• Keep your password, verification codes, and device access secure.
• You are responsible for activity performed through your account unless you promptly notify us of unauthorized access.
• Your phone number may be used to verify and identify your account.

Contact us immediately if you believe your account has been compromised.

3. The NiceApp Service

NiceApp provides messaging, group chats, contact discovery, posts, media sharing, reactions, presence, invitations, notifications, privacy controls, and related communication features. Features may vary by device, region, app version, or account status.

We may add, change, suspend, or discontinue features. We will try to provide notice when a change materially affects your use, but urgent security or legal changes may occur without advance notice.

NiceApp is not an emergency service. Do not rely on NiceApp to contact police, fire, medical, emergency, or other time-sensitive services. Message delivery and notifications may be delayed or fail.

4. Your Content

You retain ownership of messages, posts, photos, videos, audio, profile information, and other content you submit ("User Content"). You give Mozonda a limited, worldwide, non-exclusive license to host, store, process, reproduce, transmit, and display User Content only as needed to operate, secure, and improve NiceApp and comply with law.

You represent that you have the rights needed to submit your User Content and that it does not violate another person's rights or applicable law. You are responsible for what you send or publish and for keeping copies of content important to you.

5. Acceptable Use

You may not use NiceApp to:

• Threaten, harass, bully, stalk, exploit, or impersonate another person.
• Share illegal, fraudulent, defamatory, hateful, sexually exploitative, or intentionally harmful content.
• Sexually exploit or endanger a child. We have zero tolerance for child sexual abuse material and may report it to the appropriate authorities.
• Infringe privacy, publicity, intellectual-property, or other legal rights.
• Send spam, scams, unwanted bulk messages, malware, or attempts to collect credentials or sensitive information.
• Bypass access controls, probe security, scrape the service, interfere with operation, or reverse engineer NiceApp except where law expressly permits it.
• Use automated systems to create accounts or access NiceApp without our written permission.
• Use NiceApp for unlawful activity or to help others violate these Terms.

6. Safety, Blocking, and Reports

You can use NiceApp's privacy and blocking controls to limit interaction with other users. To report abuse, illegal content, safety concerns, or an intellectual-property complaint, email dercio.zunguza@mozonda.com with relevant account and content details. Do not send passwords or verification codes.

We may investigate reports and remove content, limit features, preserve information, suspend accounts, or contact law enforcement when reasonably necessary. We are not obligated to monitor every communication and cannot guarantee that all objectionable content will be identified.

7. Copyright Complaints

If you believe content on NiceApp infringes your copyright, send a written notice to the contact in Section 22 that includes: your signature; identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a good-faith statement that the use is not authorized; and a statement under penalty of perjury that your notice is accurate and you are authorized to act for the owner.

We may remove allegedly infringing material and terminate repeat infringers when appropriate. Knowingly submitting a materially false complaint may expose you to liability.

8. End-to-End Encryption

Some NiceApp conversations may support end-to-end encrypted message content. When enabled, participating devices hold the information needed to decrypt that content. Encryption does not hide all metadata, such as account identifiers, chat membership, timestamps, delivery information, or encrypted payload size. Recipients can still save, copy, forward, or capture content after receiving it.

Not every NiceApp feature or message type is necessarily end-to-end encrypted. Do not assume a feature is encrypted unless the app indicates that it is.

9. Third-Party Services and Connectivity

NiceApp relies on third-party services for functions such as phone verification, SMS invitations, push notifications, hosting, app distribution, and device features. Their terms and privacy policies may apply to their processing. You are responsible for internet access, carrier fees, SMS charges, and device compatibility.

10. Intellectual Property

NiceApp, including its software, design, branding, and documentation, is owned by Mozonda or its licensors and is protected by intellectual-property laws. Subject to these Terms, Mozonda grants you a personal, limited, revocable, non-exclusive, non-transferable license to install and use NiceApp on devices you control for its intended purpose.

These Terms do not transfer ownership of NiceApp or Mozonda trademarks to you.

11. Feedback

If you voluntarily provide suggestions or feedback about NiceApp, you grant Mozonda a perpetual, worldwide, irrevocable, royalty-free right to use that feedback without restriction or compensation. This does not transfer ownership of your User Content.

12. Account Suspension and Deletion

You may stop using NiceApp at any time and delete your account through Settings > Delete Account. We may restrict or terminate access if you violate these Terms, create legal or security risk, abuse other users, or if required by law.

After deletion or termination, rights granted to you under these Terms end. Provisions that logically should continue, including ownership, disclaimers, liability limits, and dispute terms, will survive.

13. Updates and Availability

You may need to install updates to continue using NiceApp. We may perform maintenance, impose reasonable usage limits, or restrict access to protect the service and its users. We are not responsible for failures caused by your device, carrier, internet connection, operating system, or third-party services.

14. Disclaimers

To the maximum extent permitted by law, NiceApp is provided "as is" and "as available." Mozonda disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted operation, permanent storage, delivery of every communication, compatibility with every device, or that NiceApp will always be error-free or secure.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by law, Mozonda and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or business opportunities arising from NiceApp. Mozonda's total liability arising from NiceApp will not exceed the greater of $100 USD or the amount you paid Mozonda for NiceApp during the 12 months before the claim.

Some jurisdictions do not allow certain liability limitations, so some of these limits may not apply to you.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mozonda and its affiliates from claims, damages, losses, and reasonable costs arising from your User Content, your misuse of NiceApp, or your violation of these Terms or another person's rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Any dispute not subject to a mandatory local consumer forum will be brought in the state or federal courts located in Maricopa County, Arizona. Mandatory consumer protections in your home jurisdiction remain unaffected.

Before filing a claim, you and Mozonda agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice. Either party may seek urgent injunctive relief when necessary to protect security or intellectual-property rights.

18. Export and Sanctions Compliance

You may not use, export, or re-export NiceApp in violation of U.S. or other applicable export-control or sanctions laws. You represent that you are not located in, ordinarily resident in, or controlled by a prohibited jurisdiction and are not listed on a government restricted-party list, except where applicable law prohibits this representation.

19. Changes to These Terms

We may update these Terms as NiceApp evolves. We will post revised Terms here and update the effective date. For material changes, we may also notify you in the app. Continuing to use NiceApp after revised Terms take effect means you accept them.

20. Apple App Store Terms

If you downloaded NiceApp from Apple's App Store, you acknowledge that these Terms are between you and Mozonda, not Apple. Mozonda, not Apple, is solely responsible for NiceApp, its content, maintenance and support, product claims, and claims that NiceApp infringes a third party's intellectual-property rights.

If NiceApp fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by the App Store terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding NiceApp. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must comply with the App Store terms and applicable usage rules.

21. General Terms

These Terms and the Privacy Policy constitute the entire agreement between you and Mozonda concerning NiceApp and supersede prior agreements on that subject. If a provision is unenforceable, it will be modified only as necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Mozonda may assign them in connection with a merger, acquisition, reorganization, or sale of assets. Headings are for convenience only.

Notices to you may be delivered in NiceApp, by email, or through these pages. Electronic notices satisfy legal communication requirements to the extent permitted by law.
